    Trade unions must act within their own constitution - cannot unionise members in sectors which fall outside the terms of their constitution

    CEPPWAWU / Pop Snacks CCMA Case No. FS440-09 dated 09/07/2009 

    “ …it is quite clear that a union is bound by its own constitution. In Gary van Wyk v Dando and van Wyk Print (Pty) Ltd. (1997) 7 BLLR 906 (LC) the Labour Court held that the admission of people not qualifying for membership in terms of the union’s constitution was ultra vires since they did not qualify for membership in terms of the union’s constitution.  In that case the union stated that it had a custom and practice to admit persons to membership who does not qualify in terms of its constitution.  The Court found that, if this had been the case, it could not have been a valid and binding custom.  See also AA Landman: Freedom of Association in South African Labour Law (1990) Acta Juridica.” 

    “Our legislator limits the application of section 21 – disputes by specifically referring to the application thereof to registered Unions only.  In itself it means that the Union is bound by its constitution as approved by the Minister of Labour.  To apply an ‘open’/’laissez faire’ approach will/can only create chaos in the workplace between the employer /employee/union(s) and between the unions inter se.  See also: NUM v Borer Beetle & Floor Sanding EC 3648-02 dated 22 July 2002 (CCMA); PTWU obo Members v Sasurel (Pty) Ltd. t/a Clinjsut ECPE 1865-03 dated 26 September 2003 (CCMA); PTWUSA v Edu College FS 3945-05 dated 26 August 2005, (CCMA) where a similar approach was followed.”
